Former President Donald Trump’s legal team has devised a strategy to argue that he is justified in questioning the results of the 2020 election in an upcoming criminal trial, bringing the former president’s continued political ambitions to court against his presidential defeat. It has not yet been decided whether Trump will be able to make those arguments in front of a jury, and a judge will have to decide whether his legal team can get the records he wants. The trial is scheduled to begin in March.

The Trump team’s request for information about the Pence investigation looked at the possibility that Pence may have spoken to special counsel investigators to help himself and the handling of records classified as separate investigations.

The investigation into Pence’s classified records came earlier this year after Pence’s team found documents marked in his home as part of a criminal investigation into Trump’s mishandling of classified records. The Pence investigation ended in June without any criminal charges.

In the spring, Pence testified before a federal grand jury in the 2020 election investigation.

“The criminal charges against Vice President Pence have encouraged the Biden administration to curry favor with officials by providing information of its choosing and relevant to the case,” Trump’s lawyers wrote.

A spokeswoman for Pence declined to comment Tuesday.

Pence’s secret testimony in the Trump 2020 election case came after some of his aides testified under oath before a federal grand jury, and the judge ruled that he must answer questions under subpoena.

The Trump team is seeking records about the Russia investigation and other foreign attempts to influence presidential elections — a political reality the Trump team has tried to distance itself and its campaign from for years after winning the 2016 presidential election.

Evidence of covert foreign disinformation campaigns related to the 2020 election supports the defense’s argument that President Trump and others acted in good faith even if the reports were ultimately deemed inaccurate, Trump’s lawyers wrote in court filings.
